Pasir Mas Magistrate’s Court Acquits Saiful Helmi of Drug Possession Charges.

Saiful Helmi Bin Hussin was acquitted of a drug possession charge by the Magistrate’s Court in Pasir Mas. He was charged under Section 12(2) of the Dangerous Drugs Act 1952, punishable under Section 39A(1) of the same Act. During a raid on his home in January 2020, police found methamphetamine tablets in a DHL bag hidden near a cockfighting area behind his house. Saiful claimed the roosters were his main source of income, denying knowledge or possession of the drugs found. The defense argued that the drugs were discovered about 23 meters away from his house, suggesting he had no control over them. Additionally, they invoked adverse inference under Section 114(g) of the Evidence Act 1950 against the prosecution for not calling key witnesses. Saiful was represented by Dato’ Geethan Ram Vincent and Revin Kumar.
