Court of Appeal set aside the murder charge conviction.

Today, the Court of Appeal overturned the conviction of Muthukumar a/l Sinnathamby, who faced charges of murder and causing hurt in 2015. The case originated from an incident where Muthukumar allegedly attacked three men, resulting in the death of one and injury to another. The prosecution called 21 witnesses, including eyewitnesses to the incident. Muthukumar was convicted by the High Court in 2018 based on the prosecution’s case, but he appealed the decision.

During the appeal, Muthukumar’s counsel, Dato’ Geethan Ram Vincent, together with Revin Kumar, raised several issues. They argued that the prosecution failed to prove beyond a reasonable doubt that Muthukumar committed the crime, questioned the credibility of the eyewitnesses, highlighted a break in the chain of causation, criticized the trial judge’s judgment, and raised concerns about the non-production of the deceased’s medical records.

The three-judge panel, convinced by the defense’s arguments, overturned the conviction and acquitted Muthukumar. They particularly focused on the credibility of the eyewitnesses. Muthukumar, now 62 years old, walked out of the courtroom relieved, no longer bound by his conviction.
