Two Men Charged With Armed Robbery Found Not Guilty

In the Sessions Court in Petaling Jaya, Danasilan a/l Suntharason and Premkumar a/l Mogan were acquitted of three charges under the Firearms (Increased Penalties) Act 1971 (FIPA). Judge Norshila binti Dato Haji Kamaruddin found that a prima facie case was not established, so the two men were not required to enter their defenses.

The prosecution alleged that the two men, along with four others, attempted to rob the Poh Kong gold store in Atria Mall, Damansara Jaya. During their escape, Danasilan was shot by police after allegedly pointing a gun at them, while Premkumar surrendered.

Premkumar was charged under Section 9 of FIPA for gang robbery with knowledge that Danasilan possessed an unlicensed Colt .45 gun. Danasilan faced charges under Section 4 of FIPA for brandishing the gun, putting a security guard in fear, and under Section 8(a) of the Arms Act 1960 for possessing live bullets without a license.

Despite the prosecution calling 10 witnesses, the evidence was insufficient to establish a prima facie case, particularly since the key witness, security guard Amir Beek Roda, was not called to testify. The defense argued that this gap was detrimental to the prosecution’s case.

Both Danasilan and Premkumar were represented by Dato’ Geethan Ram Vincent and Revin Kumar.
